1. About these terms

These terms form a legal agreement between you and Tadash regarding your use of the site. We may update them from time to time, as described in “Changes to the site and these terms” below. Your continued use of the site after changes take effect means you accept the updated terms.

2. About Tadash

Tadash provides energy audit infrastructure for UK ESOS Lead Assessors. This site describes the Tadash product and lets you request a demonstration. The site itself does not provide the product platform, and using the site does not grant access to it.

3. Who may use this site

By using the site, you confirm that:

• you are at least 18 years old;
• if you use the site on behalf of an organisation, you have authority to act for that organisation;
• any information you provide is accurate and lawful;
• your use of the site complies with applicable laws and these terms.

If you use the site on behalf of an organisation, “you” refers to both you and that organisation.

4. Acceptable use

You agree not to:

• use the site in any unlawful, harmful, or fraudulent way;
• upload or transmit malicious code, or attempt to gain unauthorised access to the site or related systems;
• interfere with, disrupt, or overload the site;
• scrape, copy, reverse engineer, decompile, or attempt to extract the source code or underlying structure of the site;
• resell, sublicense, or commercially exploit any part of the site without our written permission;
• infringe the intellectual property or other rights of any party.

We may restrict or withdraw access to the site if we believe your use creates legal, security, operational, or reputational risk.

5. The Tadash platform and private beta

The Tadash product platform is made available separately to pilot customers under a separate beta or pilot agreement and a data processing agreement. Nothing on this site grants you access to the platform or creates a service contract for it. Any access to or use of the platform is governed solely by those separate agreements.

6. No professional advice and no guaranteed outcomes

Information on this site is general information about Tadash and is provided for that purpose only. It does not constitute energy, legal, compliance, financial, or other professional advice, and you should not rely on it as such.

Tadash is a tool that supports the energy audit workflow. We do not guarantee compliance with the Energy Savings Opportunity Scheme (ESOS) or any other scheme, acceptance of any submission by the Environment Agency or any other authority, or any particular audit, financial, or business outcome. The Lead Assessor and the qualifying organisation remain professionally and legally responsible for any audit, notification, or submission they prepare, sign, or rely on.

7. Intellectual property

Tadash and its licensors own all rights, title, and interest in the site and its content, including software, text, designs, layouts, graphics, and related materials. These terms do not transfer any of that intellectual property to you.

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and view the site for your own legitimate, non-commercial information purposes. You may not copy, modify, distribute, sell, or create derivative works from the site unless we expressly permit it in writing.

8. Trademarks

“Tadash”, the Tadash name, and the Tadash logo are marks of Tadash Ltd. You may not use them without our prior written permission. Nothing on the site grants any right to use our marks, and nothing should be read as implying any endorsement or partnership without our written agreement.

9. Third-party links and services

The site may link to or rely on third-party websites, tools, or services. We are not responsible for third-party content, availability, security, or practices. Your use of any third-party service may be subject to that provider’s own terms and policies.

10. Disclaimers

To the maximum extent permitted by law, the site is provided on an “as is” and “as available” basis. We do not warrant that the site will be uninterrupted, timely, error-free, or secure, or that the general information on it is accurate, complete, or current. The site may be unavailable from time to time due to maintenance, updates, outages, or circumstances beyond our control.

11. Limitation of liability

To the maximum extent permitted by law, Tadash will not be liable for any indirect, incidental, special, consequential, or punitive loss, or for loss of profits, revenue, goodwill, data, or business opportunity, arising out of or in connection with your use of the site.

Nothing in these terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

12. Indemnity

You agree to indemnify and hold Tadash harmless from any claims, losses, liabilities, and reasonable costs arising from your misuse of the site, your breach of these terms, or your violation of applicable law or the rights of others.

13. Privacy

Our processing of personal data in connection with the site is described in our privacy policy. By using the site, you acknowledge that we may process personal data in accordance with that policy and applicable data protection law.

14. Changes to the site and these terms

We may change, suspend, or discontinue any part of the site at any time. We may also update these terms from time to time. If we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the site after changes take effect means you accept the updated terms. If you do not agree, you must stop using the site.

15. Governing law and jurisdiction

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or relating to these terms or the site, except where applicable law requires otherwise.

16. General

These terms, together with our privacy policy, form the entire agreement between you and Tadash regarding your use of the site. If any part of these terms is found to be unenforceable, the remaining parts will continue in effect. Our failure to enforce any provision does not waive our right to enforce it later. You may not assign your rights or obligations under these terms without our prior written consent; we may assign these terms in connection with a merger, acquisition, restructuring, or sale of assets.
